The ATF is in the News and NOT in a Good Way

The Federal Bureau of Alcohol Tobacco and Firearms (ATF) have been in the news this year and not in a good way. Joe Biden is attempting to restrict lawful gun ownerโ€™s rights by political caveat rather than Constitutional and legal means of Congressional approved new laws.

Vice President Kamala Harris in a press release of April 11th said, โ€œToday, as the head of the White House Office of Gun Violence Prevention, I am proud to say that all gun dealers must conduct background checks no matter where or how they sell,โ€

In an online news story of about a week ago โ€œWashington Gun Lawโ€ President, William Kirk, discussed the story of Bryan Manilowski, who was gunned down by ATF agents in March during a raid. Kirk asked the question, โ€œWhy did the ATF pick perhaps the most dangerous way to execute this warrant?  It’s almost as if they wanted to get into a gun fight.โ€

Kirk then went on to explain how the ATF raided Manilowskiโ€™s private residence in the middle of the night as the family slept knowing that Manilowski was most probably armed and would respond accordingly. Bryan Manilowski was gunned down by the ATF in his home protecting his family against what he most probably thought was a home invasion.

The Manilowski family is now suing the ATF and as Kirk explains in his video, โ€œNow the Manilowski family attorney is beginning to ask questions and one would think that an agency such as the ATF has all the answers, right?  Well at least you can look at the video recording of what happened to determine the lawfulness of their actions, right?  Well, think again.  The answers might surprise you.โ€

Kirk points out ATF agents were not wearing cameras.  In fact, it has been reported the Manilowski family Ring doorbell video device shows agents disabling that device before the raid.

So the way the story goes is Bryan Malinowski, (53) was the executive director of Little Rockโ€™s โ€œBill and Hillary Clinton National Airportโ€, and was a law-abiding gun enthusiast. One of his passions was to buy, sell, and trade guns the same way some people do so with vehicles. He was shot defending himself and family when ATF agents broke into his home in the dead of night to serve a Federal search warrant. It is not known if they announced themselves to wake him up and most probably never will.

Malinowski may have been selling over 100 firearms per year as a hobbyist. But the valid question comes up; Did he even know the ATF was investigating him as doing something wrong and breaking a โ€œlawโ€? Malinowskiโ€™s house was raided by ATF on March 19 when he was shot and killed. The Biden-Harris Administration announced their new rules on April 11. Those rules related to gun selling and background checks are expected to take effect in 30 days from April 11th.

The Biden administration will be under the microscope as the law has been intentionally vague as to how many guns you can sell before you have to register yourself as a FFL dealer. The law has basically held โ€œoccasional salesโ€ only, and โ€œno set number of transactionsโ€ per year. As such, it is very probable Malinowski did not think he was doing anything wrong.

The ATF is now under the microscope by Congress relative to their conduct in the Malinowski raid. And Republican Attorney Generals are having none of this as well.

Texas A.G. Ken Paxton (R) said in a press release:

โ€œYet again, Joe Biden is weaponizing the federal bureaucracy to rip up the Constitution and destroy our citizensโ€™ Second Amendment rights,โ€ said Attorney General Paxton. โ€œThis is a dramatic escalation of his tyrannical abuse of authority. With todayโ€™s lawsuit, it is my great honor to defend our Constitutionally-protected freedoms from the out-of-control federal government.โ€

A follow-up story reports 26 State Attorney Generals (AGs) have now joined this lawsuit against the Biden administration.

CONCLUSION:

Yesterday I found it very interesting Arkansas Governor Sarah Sanders (R) signed an executive order for her state to follow state law over the Biden administration’s new interpretation of Title IX relative to biological men in biological womenโ€™s sports, locker rooms, bathrooms, and dorm rooms. Maybe there was no connection between her action and the needless death of Bryan Malinowski but, maybe there was.

The Malinowski familyโ€™s hiring of Attorney Bud Cummins is also an interesting development to this story. Cummins is a Republican who actually served as U.S. Attorney from 2001-2006 in the United States District Court for the Eastern District of Arkansas. He knows the law!

This case offers more questions than answers right now as noted in this local news article.

In my humble opinion, the only two things that can keep this nation from a second civil war at this point in time are a fair and transparent General Election this year and a justice system impartial to political parties and very partial to the Constitution and laws of the land. The Biden administrationโ€™s weaponization of the DOJ against former President Donald Trump almost assures us a war is now coming.   

Joe Bidenโ€™s โ€œrulesโ€ are not the law. He is not a king! He is an usurping American president worthy of impeachment.

And not to sound like a liberal but I find the name of the โ€œBill and Hillary Clinton National Airportโ€ very offensive so it needs to change!
