Jan. 6 Defendant Rearrested 2 Days After Trump Pardon

A man charged over the Jan. 6, 2021, breach of the U.S. Capitol is still in custody after prosecutors brought fresh charges in the wake of President Donald Trumpโ€™s wave of pardons for Jan. 6 defendants.

Daniel Ball was arrested on Jan. 22 in Washington, according to an arrest warrant filed with the federal court system in the city, a day after a federal judge granted a request by U.S. prosecutors to drop Jan. 6-related charges against Ball.

Ball was arrested on charges of illegally possessing a gun and ammunition despite previous felony convictions, according to an indictment filed in Florida.

A page attached to the warrant says that Ball, a Florida resident, โ€œis a two-time convicted felon with prior convictions for domestic violence battery by strangulation and resisting law enforcement with violence.โ€ The warrant was signed on Aug. 6, 2024, but not executed until this week.

Itโ€™s unclear why the warrant was not executed until now. The U.S. Department of Justice did not respond to a request for comment.

Ball was arrested while still in prison in Washington, his lawyer, Amy Collins, told The Epoch Times.

According to the indictment, Ballโ€™s illegal firearm possession was discovered on May 2, 2023.

Authorities arrested Ball in the Jan. 6 case on May 2, 2023.

Trumpโ€™s order grants full, complete, and unconditional pardons to people convicted of crimes โ€œrelated to events that occurred at or near the United States Capitol on January 6, 2021.โ€

It directs the attorney general to immediately issue certificates of pardons to Jan. 6 defendants and ensure that people convicted of Jan. 6-related offenses and currently held in prison are โ€œreleased immediately.โ€

โ€œI further direct the Attorney General to pursue dismissal with prejudice to the government of all pending indictments against individuals for their conduct related to the events at or near the United States Capitol on January 6, 2021,โ€ Trump wrote.

Collins said that Ballโ€™s lawyers think the new case should be dismissed under the pardon.
