Biden’s New Title 9 Revisions Stopped in Court!

Monday a federal judge again blocked the Biden administration’s Title IX rule changes to allow biological men to participate in women’s sports under the guise of anti-discrimination protections for trans students. The judge noted that “sex” and “gender identity” are not the same concept so trans students do not have a legal or constitutional right to compete outside their God given gender at birth.

On Monday, Chief Judge Danny Reeves issued his ruling for Tennessee v. Cardona in the U.S. District Court of Eastern Kentucky, temporarily preventing Biden’s Title IX rule change from going into effect in Kentucky, Indiana, Ohio, Tennessee, Virginia and West Virginia. In Judge Reeves 93-page ruling, he wrote the Department of Education “fails to provide a reasoned explanation for departing from its longstanding interpretations regarding the meaning of sex.”

Riley Gaines has become a leading activist against this perversion of biological men unfairly competing against biological women in college and professional sports after she was unfairly snubbed in an awards ceremony at a NCAA swim meet. In 2022 University of Pennsylvania trans swimmer Lia Thomas and Kentucky swimmer Riley Gaines tied for 5th in the 200 Freestyle finals at the NCAA Swimming and Diving Championships of the McAuley Aquatic Center in Atlanta, Georgia. Gaines was asked to step aside to let Thomas receive the award for the photo op with her award to be ordered and delivered to her later.

Thomas had competed as a male swimmer William Thomas without much success until 2019 when he was introduced to the U. Penn women’s swim team as Lia Thomas. Just last week Thomas lost a legal battle to compete in the Olympics.

In April, the Department of Education published a Biden administration revision to the federal anti-discrimination protections outlined in Title IX which dates back to 1972. The new rules are set to go into effect on August 1 this summer.

A press release from Tennessee Attorney General Jonathan Skrmetti, called the ruling “a big win for the Constitution and the people of Tennessee,” noting the Biden administration’s new Title IX rules represent “profound changes to the law that the American people never agreed to.”

From the point of view of the progressives on the left the intent of Biden’s Title 9 changes was to extend discrimination protections to LGBTQ+ students by expanding the definition of “sex discrimination” to include queer, transgender, and intersex people. The rule changes are intended to protect trans students’ rights to use gendered facilities that match their gender identities and include the right to be addressed by their desired name and pronoun. The new rules would apply to any institution that receives Federal Title 9 funding.

From the point of view of conservatives on the right they have equal and opposite concerns as follows:

  • Trans women competing against biological women have an unfair advantage in most all sports and most all situations. William Thomas competing as Lia Thomas is the perfect example.

  • Just because somebody declares themselves a member of the opposite sex does not change their body and body mass so not only do they have an unfair advantage, biological men can still physically hurt biological women without intending to in contact sports.

  • It is impossible to know the legitimacy of a trans woman in a restroom or locker room of biological women relative to sexual arousal. In other words: How many men might be pretending to be women just for a cheap thrill?

While the left sites a poll 2023 poll conducted by the Public Religion Research Institute claiming that the majority of Americans (79%) support anti-discrimination laws for LGBTQ+ people, a 2023 Gallup poll actually found the opposite to be true at 69% do not want men in women’s sports.

This new Tennessee decision comes shortly after U.S. District Judge Terry A. Doughty issued a ruling last week blocking the new Biden Title IX rules in Louisiana, Mississippi, Montana and Idaho. The U.S. Court of Appeals for the Sixth Circuit also issued a decision to block the new Title IX rules in over a dozen other states. The Biden administration’s preliminary guidance documents regarding the Title 9 rule changes are now blocked in 21 states, with the final rule being preemptively blocked in 10 states, according to the legal analysis blog Law Dork.

Congressional Republicans have introduced a resolution that would repeal Biden’s Title IX rules as HJ Res. 165 which was introduced on June 5. Just last week the House Committee on Education and the Workforce voted to advance this resolution.

CONCLUSION:

I see no logical reason for this subject to have become so prominent since we are talking about less than 1% of a population deviating from the other 99% in a country where the majority rules. It seems to me what this is really about is disrespecting God, for people of faith, or the destruction of our national heritage, for secular people without a faith.

It also makes me want to change my identity. After the sham trial in Judge Juan Merchan’s New York courtroom, I want to identify as the rightful judge of that courtroom since I know right from wrong and I know the law better than he does. I want to immediately vacate the charges against former President Donald Trump and charge Manhattan DA Alvin Bragg with fraudulent malicious prosecutorial malpractice for political purposes.

Who wants to start my activist support group to make this happen for me?

Honest to God, I feel like we are living in the Twilight Zone these days!
