South Carolina Governor Allows Mask Opt-Out in Schools, Bans Vaccine Passports

South Carolina Gov. Henry McMaster on Tuesday issued an executive order to prevent local governments and school districts from mandating the wearing of masks to curb the transmission of COVID-19, the disease caused by the CCP virus.

Parents may now opt their children out of wearing masks in public schools, the governorโ€™s executive order ( see below and here) states. McMaster cited widespreadย CCP (Chinese Communist Party) virusย vaccine access for adults statewide in issuing his order.

โ€œWith the COVID-19 vaccine readily available and case numbers dropping, I will not allow local governments to use the state emergency declaration as a reason for implementing or maintaining mask mandates,โ€ McMaster saidย in a statement below.

โ€œEverybody knows what we need to do to stay safeโ€”including wearing a mask if youโ€™re at risk of exposing othersโ€”but we must move past the time of governments dictating when and where South Carolinians are required to wear a mask. Maintaining the status quo ignores all of the great progress weโ€™ve made,โ€ the Republican governor added.

The governor in his executive order said that he is directing South Carolinaโ€™s health and education departments to develop forms that can be signed by parents and legal guardians that would allow them to opt their children out of wearing masks in state public schools.

A statewide mask mandate has never been imposed by the governor, however school districts and local governments were able to independently choose whether to impose the restrictions.

The state education department currently requires that students and staff in public schools wear masks upon entering the building, while moving through hallways, during pickup and drop-off, and when it isnโ€™t possible to practice social distancing.

โ€œWith every adult in our state having the opportunity to receive a vaccine, it goes against all logic to continue to force our childrenโ€”especially our youngest childrenโ€”to wear masks against their parentsโ€™ wishes,โ€ the governor said.

COLUMBIA, S.C. โ€“ย ย Governor Henry McMaster today issuedย Executive Order 2021-23, which empowers South Carolina parents to decide whether their children should wear masks in public schools throughout the state. The governorโ€™s order also explicitly prohibits any county or local governments in the state from relying on prior orders or using a state of emergency as the basis for a local mask mandate and bars all state agencies, local governments, and political subdivisions from requiring what has commonly been referred to as โ€œvaccine passportsโ€ for any reason.

With regard to mask requirements in public schools, the governor has directed DHEC – in consultation with the S.C. Department of Education – to develop and distribute a standardized form a parent or legal guardian may sign to opt their child out of mask requirements imposed by any public school official or public school district.

โ€œWe have known for months that our schools are some of the safest places when it comes to COVID-19,โ€ said Governor Henry McMaster. โ€œWith every adult in our state having the opportunity to receive a vaccine, it goes against all logic to continue to force our children โ€“ especially our youngest children โ€“ to wear masks against their parentsโ€™ wishes. Whether a child wears a mask in school is a decision that should be left only to a studentโ€™s parents.โ€

Concerning local ordinances, the governorโ€™s executive order explicitly prohibits any county or local governments throughout the state from relying on prior orders or a state of emergency as the basis for a local mask mandate.

โ€œWith the COVID-19 vaccine readily available and case numbers dropping, I will not allow local governments to use the state of emergency declaration as a reason for implementing or maintaining mask mandates,โ€ said Gov. Additionally, the governorโ€™s order prohibits any local government, state agency, state employee, or any political subdivision of the state from requiring South Carolinians to provide proof of their vaccination status as a condition for receiving any government services or gaining access to any building, facility,ย  or geographic location.ย As Governor McMaster recently said: โ€œVaccine passports will have no place in South Carolina. The very idea is un-American to its core.โ€
