House Oversight Committee Chairman James Comer and Iowa Republican Sen. Chuck Grassley on Wednesday fumed as the FBI failed to meet a subpoena deadline to provide congressional investigators with a form that allegedly details a bribery scheme between then-Vice President Joe Biden and a foreign national.

The Republicans revealed in early May that the FBI had an FD-1023 in its possession detailing the allegations and confirmed they had issued a subpoena to obtain the document. Comer and Grassley learned of the form’s existence from a whistleblower. The form allegedly includes a “precise description” of the scheme and its purpose.

The FBI, however, did not honor the subpoena by the deadline. Instead, acting Assistant Director of the bureau’s Office of Congressional Affairs Christopher Dunham wrote to Comer on Wednesday, informing him that the bureau had to be mindful of “executive branch confidentiality interests and law enforcement responsibilities.”

In the letter, which the New York Post obtained, Dunham informed Comer that “The FBI appreciates this opportunity to inform you of our confidentiality interests so that we can ‘seek optimal accommodation through a realistic evaluation of’ each other’s needs and ‘avoid the polarization of disputes.'”

“We are committed to working together through this process,” he assured the Kentucky Republican.

Both Comer and Grassley deemed the response unsatisfactory.

“It’s clear from the FBI’s response that the unclassified record the Oversight Committee subpoenaed exists, but they are refusing to provide it to the Committee,” Comer insisted. “We’ve asked the FBI to not only provide this record, but to also inform us what it did to investigate these allegations.”

“The FBI has failed to do both. The FBI’s position is ‘trust, but you aren’t allowed to verify.’ That is unacceptable. We plan to follow up with the FBI and expect compliance with the subpoena,” he declared.

Grassley, meanwhile, affirmed his belief in the document’s existence and questioned the bureau’s approach to addressing the allegations.

So the question remains, what did the FBI do to investigate very serious allegations from an apparent trusted FBI source implicating then-Vice President Biden? Today’s letter from the FBI raises additional questions, including whether the FBI has an open investigation based on these allegations. The American people pay the FBI’s salaries, and they’re entitled to a fulsome response,” Grassley said.

“It’s clear from the FBI’s response that the unclassified record the Oversight Committee subpoenaed exists, but they are refusing to provide it to the Committee. Based on whistleblower disclosures, the Department of Justice and the Federal Bureau of Investigation possess an unclassified FD-1023 form that describes an alleged criminal scheme involving then-Vice President Biden and a foreign national relating to the exchange of money for policy decisions. It has been alleged that the document includes a precise description of how the alleged criminal scheme was employed as well as its purpose.

Congressional subpoena seeks specific FBI document

WASHINGTON – Senate Budget Committee Ranking Member and long-time whistleblower advocate Chuck Grassley (R-Iowa) and House Committee on Oversight and Accountability Chairman James Comer (R-Ky.) today are demanding the FBI produce an unclassified record alleging a criminal scheme involving then-Vice President Joe Biden and a foreign national. The document, an FBI-generated FD-1023 form, allegedly details an arrangement involving an exchange of money for policy decisions. Comer issued a subpoena today following legally protected disclosures to Grassley’s office.

“We believe the FBI possesses an unclassified internal document that includes very serious and detailed allegations implicating the current President of the United States. What we don’t know is what, if anything, the FBI has done to verify these claims or investigate further. The FBI’s recent history of botching politically charged investigations demands close congressional oversight,” Grassley said.

“The information provided by a whistleblower raises concerns that then-Vice President Biden allegedly engaged in a bribery scheme with a foreign national. The American people need to know if President Biden sold out the United States of America to make money for himself. Senator Grassley and I will seek the truth to ensure accountability for the American people,” Comer said.

Grassley has long raised concerns about political bias infecting high-level investigative decisions at the FBI, including investigations related to the Biden family’s foreign business arrangements and bank records. While FBI Director Christopher Wray pledged to prevent any retaliation targeting whistleblowers, the FBI and Justice Department have thus far refused to voluntarily provide responsive records or answers to congressional inquiries related to its handling of these politically sensitive investigations.

Comer and the Oversight Committee are investigating the Biden family’s suspicious business schemes to determine if the Biden family has been targeted by foreign actors, if President Biden is compromised, and if there is a national security threat. The Oversight Committee has obtained thousands of pages of financial records related to the Biden family and their associates’ business transactions. Recently, the Committee revealed one deal that resulted in several members of the Biden family and their companies receiving over $1 million in more than 15 incremental payments from a Chinese company through a third party.

The subpoena requires the FBI to produce in unredacted form all FD-1023s that contain the word “Biden” and all accompanying attachments and documents.
