Biden Violates Federal Law with Shot Mandate

WASHINGTON, D.C. โ€“ Joe Biden announced a โ€œplanโ€ attempting to illegally force COVID shots on more Americans, including federal employees, all private employers with 100 or more employees, health care workers, educators and even children.

Biden signed an executive order today attempting to force the COVID shots on all federal employees, including contractors who conduct business with the federal government, without the option to opt out for regular COVID testing. The order gives federal workers and contractors 75 days to get the shots, but there are exceptions for those seeking religious or medical exemptions.

The Department of Laborโ€™s Occupational Safety and Health Administration (OSHA) is developing a rule that will require all employers with 100 or more employees to mandate the COVID shots or weekly testing. Employers will be required to provide employees paid time off to get vaccinated.

The Centers for Medicare & Medicaid Services is taking action to require the injections for over 17 million health care workers in most health care settings that receive Medicare or Medicaid reimbursement, including but not limited to hospitals, dialysis facilities, ambulatory surgical settings, and home health agencies.

Biden is calling on entertainment venues like sports arenas, large concert halls, and other venues where large groups of people gather to require that their patrons be vaccinated or show a negative test for entry. He is also pushing COVID shot requirements for teachers, school officials and even school children.

The Biden administration is prepared to begin rolling out booster shots for Pfizer and Moderna during the week of Sept. 20. However, the statistics regarding the harm from these injections is staggering. The VAERS data shows 650,075 reported adverse events, including 13,911 deaths as of August 23, 2021 from the COVID injections.

The federal government cannot mandate these COVID injections under authorization of emergency use (EUA). There is NO FDA-approved COVID shot available in the United States. Furthermore, the shots cannot be mandatory under Title VII. In general, employee vaccine religious exemption requests must be accommodated, where a reasonable accommodation exists without undue hardship to the employer, under Title VII of the Civil Rights Act of 1964. Many people hold sincere religious beliefs against taking any vaccines, or taking those derived from aborted fetal cell lines, or taking those sold by companies that profit from the sale of vaccines and other products derived from abortion.

Employees and employers also have constitutional protections against this lawless Biden mandate. In addition, employees may also claim religious exemptions under the Religious Freedom Restoration Act of 1993. This law applies to all levels of the federal government.

Finally, Bidenโ€™s lawless mandate also collides with many state laws, including those that ban vaccine passports.

Liberty Counsel Founder and Chairman Mat Staver said, โ€œThe Biden administration has no authority to force any employee or employer to receive the COVID shots. We will challenge his lawless executive order.โ€
