Special Counsel Jack Smith Comes Under Fire

No better example that Democrats unconstitutional and illegal lawfare exists can be seen in attorney Jack Smith’s testimony before Congress.

Special Counsel Jack Smith was recently called before Congress to testify about his prosecution of President Donald Trump. Experts agree, it did not go well for him. 

Julie Kelly is a political commentator and senior contributor to American Greatness. Kelly covers political and policy issues. We are noting some of her observations of Jack Smith’s lies and deceptions here edited for space.

Lie 1

Smith said President Trump had classified documents at Mar-a-Lago and obstructed their retrieval. In fact, in the spring of 2021 President Donald Trump immediately began cooperating with the Joe Biden DOJ, FBI, and National Archive welcoming them to Mar-a- Lago.

Lie 2

While Smith denied his prosecution of President Trump was political, he was seemingly aware of the 2024 election calendar. He took what he himself described as the “extraordinary” step in asking the Supreme Court to bypass the DC appellate court in considering partisan Judge Tanya Chutkan’s (Obama Appointee) December 2023 order denying President Trump all forms of presidential immunity from criminal prosecution taking up his immunity question immediately. The SCOTUS denied his request.

Lie 3

The protest at the Capitol on Jan 6 was an “attack” incited by the president and the unsubstantiated allegation that 140 officers were injured by protesters. The fact is trouble started at the Capitol protest before President Trump was even done speaking.

Keep in mind, it was House Speaker Nancy Pelosi who rejected President Trump’s suggestion she call up the National Guard a week prior just in case (JIC). Also, while Capitol Police repelled protesters on the west side of the Capitol Building, those on the east side were letting them in!

Lie 4

President Trump’s tweet at 2:24pm noting “Mike Pence didn’t have the courage to do what should have been done to protect our Country,” somehow “endangered” Pence’s life.

Trump did not have to be “pushed” by staff to denounce the escalating chaos and this was a lie pushed by Rep. Liz Cheney and others repeated by Jack Smith. President Trump never delayed saying anything to stop his supporters from doing anything bad. Trump posted several tweets/videos asking people to “stay peaceful” and respect police.

Lie 5

Twitter (purchased by Elon Musk) did not “refuse to comply” with partisan Judge Beryl Howell’s (Obama Appointee) egregious nondisclosure order in Smith’s pursuit of the president’s Twitter data.

She set an unreasonable deadline to produce the files and as Twitter sought relief from DC appellate court, Howell, the Trump-hating Obama appointee, was upheld by 1 Obama and 2 Biden appointee judges on appeal. Twitter was then fined $350,000 for an alleged 55 hour “delay” in producing the data to Smith. Howell also suggested Musk was trying to “get in good” with Trump by fighting the NDO. And Howell did not just find “obstruction” in her justification for issuing the NDO.

Smith claimed Trump was a flight risk, one of 5 factors necessary under the Stored Communications Act in authorizing an NDO for a subpoena issued. In a hearing on the matter, Howell openly mused that Trump owned his own plane and could flee the country if he found out about the subpoena.

Both Smith and Howell later claimed what the NDO was done in “error.”

Lie 6

Smith tried to assert former President Trump was just a “normal person” when it comes to certain records and documents. In fact, a National Archives Records Administration (NARA) official testified that every president has kept classified records.

Smith’s prosecutors had to admit to Judge Cannon in the documents case that this was the first time a high ranking elected official had been charged with espionage for having (alleged) classified papers. There was nothing “normal” about the documents investigation/prosecution.

Further, Sensitive Compartmented Information Facility (SCIF) in Miami was not “convenient” for the president or his team of lawyers. Smith’s team insisted on being near or inside the SCIF when the president and/or his team viewed sensitive evidence. Judge Cannon directed Smith to make classified discovery available in Florida.

Lie 7

Jack Smith now claims he doesn’t recall how or who swore him in as special counsel to prosecute former President Donald Trump. In fact, Smith was so desperate for the job that he accepted the appointment while laid up with a fractured leg from a bike accident and made top DOJ officials fly to the Netherlands a few times to brief him.

So the most powerful prosecutor in the country with unchecked authority to spend $50 million in taxpayer dollars, haul dozens of people including top government officials before grand juries, and come up with 2 unprecedented criminal indictments against a former president can’t recall the circumstances of taking an oath of office while overseas?

CONCLUSION:

President Trump likes to tag people with names and title. His name for Jack Smith is “Lying Jack Smith”. Abigail Jackson, a White House spokesperson, in a statement said that “Jack Smith is a lying hack who willingly weaponized the justice system against President Trump to try and benefit his Democrat cronies.”

One of the few things I think President Trump does wrong is he uses terms (calls names to the liberals) without context. When people do get context to his tags/nicknames most people wind up musing “Trump was right again.” It is my sincere hope that the above article with content provided by Julie Kelly offers some context to Trump’s nickname for Jack Smith.

I would go further in summarizing Jack Smith. People like Smith are dangerous to America. They can get themselves killed at the least and start a civil war at most. January 6 was an “unarmed protest” and not an “armed insurrection” so that was the first lie told in this whole charade.

The unwillingness of Jack Smith to do the right thing and drop all charges and apologize after classified documents were discovered in President Joe Biden’s garage dating back to when he was both a Senator and Vice President made many Trump supporting patriots want blood. Nobody but a former President is allowed to have such documents in their private possession. This means Joe Biden broke the law twice as Senator and Vice President.

The Democrat’s hypocrisy in this instance was above and beyond and made me wonder if they were actually trying to start a civil war? The fact that the FBI who raided President Trump’s Mar-a-Lago home was authorized to use deadly force supports my suspicion.

Some say Jack Smith should now be prosecuted himself, I agree.

Fun Facts:

Jack Smith admitted his key January 6 witness, Cassidy Hutchinson (aka Clavicle Girl to Trump), relied on hearsay with zero firsthand evidence. Hutchinson’s testimony on June 28, 2022 was a blatant lie. Trumps Secret Service immediately refuted it, but their testimony was denied. Liz Cheney colluded with Hutchison. The House Oversight has referred her and former Rep. Liz Cheney (R-WY) for criminal investigation.

The House GOP dropped Jack Smith’s 255-page deposition transcript and 8+ hour video if anybody cares to read/watch that much fiction.

Jack Smith’s wife, Katy Chevigny, produced Michelle Obama’s 2020 Netflix documentary “Becoming” and donated to Joe Biden’s 2020 Presidential Campaign. Her mother, Jack Smith’s late mother-in-law, was a SOROS Senior Justice Fellow at his Open Society Foundation.

The above indicates Jack Smith clearly had a conflict of interest in this case.

Jack Smith was never even approved by a vote of the Senate to be a Special Counsel!
